Grand Jury Indictment In Deatherage Case

A Montgomery County grand jury yesterday (April 22, 2013) indicted 52 year old Johnny B. Felton Jr.of Hinesville Georgia.
The grand jury returned with two counts. Felton is charged with a class 2 felony offense of Reckless Homicide for his conduct that caused the death of Illinois State Trooper Kyle Deatherage on November 26, 2012.
The indictment alleges that Felton operated a semi-tractor trailer on
northbound Interstate 55 at time while acting in a reckless manner. Failing to change lanes or reduce speed after seeing a stationary emergency vehicle with lights activated, and traveled across the fog line, causing the death of Trooper Deatherage.
This charge is a class 2 felony punishable by up to 14 years incarceration in
the Illinois Department of Corrections.
Felton was also charged with a second felony count alleging that he willfully operated a commercial motor vehicle in the State of Illinois when he did not have a valid commercial driver’s license.
This charge is a class 4 felony punishable with up to 3 years incarceration in the Illinois Department of Corrections.
Bond was set at $250,000.00 on the two charges.
Felton was taken into custody this morning, (April 23, 2013), in Hinesville, Georgia. Felton has waived extradition and is being transported from Georgia to Montgomery County for arraignment on his pending felony charges.
